Team 3/Chapter 5 Critical Thinking Questions

Question 1.
Take a tour of your local courthouse. How does the description match the one at the beginning of this chapter? Compare notes with other classmates;perhaps they focused on features that you did not
Honestly, there are only to times that I've actually been inside of a courthouse. The two times that I visited were for jury duty and a sentencing hearing for a vehicular homicide. The courthouse is located at 13th and filbert (the justice center). My first experience in the courthouse was that it was really noisy just like the one described in the text. I walked in to lines people. There were four lines. The first was for employees of the justice center, the second for people who wanted to check celluar phones, and the last two were for those reporting for jury duty. Once inside, the building was actually very nice and not raggedy and unkept as the text describes. I passed through the metal detectors and proceeded to a room full of people reporting for jury duty. I didn't have to climb any stairs, I did however feel like the entrance was narrow because there were so many people.
I remembered sitting in this room for what seemed like an eternity.
I don't remember the order in which I was called. I do remember being called to a court room, where I was asked to fill out a questionare. The other jurors and myself sat and waited for the court to proceed, the judged arrived with more questions for each juror. All I think of is please do not pick me as a juror in this case! I wasn't picked for that case, but I was sent back down to the jurors room to be picked for another case. I couldn't believe it (the same thing again), I wasn't picked a second time as a juror and was sent home with a nine dollar check and eight hours of my day gone. In comparison to the courthouse to the Justice Center there are similarities and differences. Two positive things that can be said about the justice center is that security is good and the building is beautiful.
My second experience involved family members. We passed through the metal detectors and proceeded to the elevators where there were lots of people. We then packed ourselves in with the others. We then proceeded to the courtroom where our family and the defendants family sat. The judge entered and we heard the details of the case (including a plea bargain). After listening to the charges we then heard the sentence that would have been imposed had the case gone to trial. The defendant could have received thirty years. Afterwards, the prosecutor (who was unfamiliar to our family) discussed the plea bargain in a room with our family. We accepted and that was the end of the sentencing hearing for eveyone. He received 5 to 10 years in prison.

My first time ever going to City Hall was actually last week and when I experienced in walking past one of the court rooms I felt that it is rather similar to the one in this chapter. Also it really does look like that people back in time were concerned on how buildings were actually being built. City Hall also has an information booth so if you ever need any assistance you can always ask the police officer who is at the booth which will guide you to where ever you may need to attend. Also surrounding City Hall seems dustered and how a lot of different buildings are all around City Hall which the buildings are very close, which sort of reminds me of New York City with traffic all the time and everyone looking very busy.

Question #1. Our local courthoses are very similar to the one described in chapter 5. We have what is call an assembly-line justice. When you walk in the court room you see everyone is in a hurry. There are many people for the many different task that go on day to day in a courthouse. You generally don't know the identity of anyone until it's time to start the proceding. Then you realize that the women and men you have been looking at breezing by are the prosecution, the defense, the stenographer, etc. You also see conversations being held in the hallways. I have the tendency to believe this is where they try to meet before he trial to come to some type of agreement before the proceedings
Question #2. As a felony court prosecutor, the cooperation of the other members of the courtroom work group can be very beneficial. A prosecutor is one of the members of the work group thats considered to be a regular. They know the group and work closely with them on a consistant basis. It's important that they all work together. The book states that they have shared decisions, If someone makes a bad decision that will make the entire group look bad. He knows the way some Judges rule and have a basic general idea of how the judges in the courthouse work. The same goes for judges. They work very closely with the other staff as well on a regular basis. They know the prosecutors and whether they are rying to be fair and that enables him to have more trust in the staff that he works with. I think it's beneficial for everyone except the defense. He's just a visitor.
Question #3. The effect that delays have on the citzens is most important to me. Since we rely on our citizens so much, and present jury duty as our debt ti society, I believe that thier lives should also be considered. So often we have delays in the courthouse that as soon as someone sees a summons in the mail to report to jury duty, we start think of excuses to get out of it. If we thought that their was even on light chance that the proceedings would e fast and accurate, we would be lining up for jury duty. The least important to me is the defendant. i know I sound unfair but prosecutors don't just walk up to a person and say "Hey, I'm going to try you for murder today." You have to put yourself in a position to become a suspect. Sometimes it is just being the wrrong place at the wrong time but you have to do the right thing to clear yourself. With that being said, if you have to spend five months in jail because of delays just think what were you doing there anyway.
Question #4. The thought that the prosection may illegitimately seek contiinuances doesn't surprise me. In a world where everything is used to a person's benefit and where we constantly seek for loop holes in the law that would beneit us, I'm sure that there has been times when the prosecution has used this to their advantage. In the Barker case, it seemed unfair that the prosecution was able to prolong the trial as long as they did. I'm not sure that they even had a legal reason to prolong it, but since they got away with it, I'm sure they will use it again.

Several consequences of delay, which one do you think is the most important? and which is the least?
One consequence of delay that I feel is important is the defendants right to a speedy trial, because of the fact that defendants just go to jail for a number of months before determining weather the defendant is guilty or innocent so personally it is not right to just keep a defendant in jail if you had not had a trial yet and what I feel that is really less important, is that delay erodes the public to their confidence in the judicial process, which is basically forcing the victim and witness back down to court for a repeating trial for actually no reason at all, and apperences like that can cost citizens lots of money and time.

Personally I do feel that a danger prosecutor would try to continue his or her crime again because of the fact that most of the time which to me is actually not surprising at all an offender would get that edge to a commit a crime and most likely would commit that crime over and over again there is really no way in stopping that criminal at all even if we as citizens try to get the criminal some help there is really no point so they should just be incarcerated even though it does cost a lot of money to even incarcerate these repeating criminals.
